Harmonised classification of dinitrogen oxide: EIGA’s views
The French Authorities submitted a dossier on 10/01/2022 for harmonised classification of dinitrogen oxide.
It was checked and accepted by ECHA on 25 April 2022. The following classification is mentioned in the dossier:

During the public consultation period from 16/5/22 to 15/7/22, EIGA entered a comment paper.
RAC published their report on 25/6/23 and is supporting the proposal for harmonised classification.
The proposed harmonised classification and introduction in annex VI of CLP will be discussed by CARACAL on 20/03/24.
EIGA members decided to take further action and send more comments to CARACAL.
We ask the CARACAL to:
• ensure that the hazard classification is not based on overexposure by voluntary abuse;
• review how RAC has chosen to proceed with an opinion since the test method requirements of OECD and ECHA Guideline on CLP are not met;
• question that the same studies lead to different conclusions;
• not accept the deviation from established process and guidelines at the risk of setting precedents.
